EB-5 Investor Visa Lawyers: Securing U. S. Jobs & Securing Your Future in the United States
The “EB-5” is an acronym taken from the visa’s full name: Employment-based fifth preference category. The visa is also called the EB-5 Immigrant Investor Visa Program.
Since 1990, the EB-5 visa status has been an option for immigrant investors to enter the United States with the intention of becoming lawful permanent residents. This is in contrast with the E-2 investor treaty visa, which is explicitly a non-immigrant visa.
In addition to the primary visa holder (the investor), the EB-5 program allows foreign investors to bring their spouses and unmarried children under the age of 21 to the United States with a path to permanent residency.
Major Investment Required & Regional Service Centers
The purpose of the EB-5 program is to promote American jobs and economic growth by attracting investors whose investment will create ten or more jobs in the US job market. As of November 2019, the US Department of Homeland Security published a new rule resulting in significant changes to the EB-5 program.
One of these changes pertains to the minimum investment amount. The standard investment amount is currently $ 1.8 million. However, the EB-5 program allows for a lesser investment of $ 900,000 if the investment is into a targeted employment area (or TEA). A targeted employment area is either a rural area or an area with high unemployment relative to the national average. It is the responsibility of visa applicants to identify a TEA and outline in their applications how their investment will benefit the TEA’s residents.
One option is to invest through an EB-5 Regional Service Center. This is a classification that is designated by USCIS which authorizes a specific entity to accept capital from foreign investors. The benefit to investing capital through a Regional Service Center is that these entities and their respective plans are designed to economically impact a TEA; therefore, the alternative minimum investment amount of $ 900,00 becomes a viable option.
EB-5 Recipients and Projects: A Snapshot
As of early 2020, almost 80,000 investors had applied for the EB-5 visa program. While four out of five came from one of four countries – China, South Korea, Taiwan, and the United Kingdom – a significant number of applicants represented Brazil, India, Mexico, Nigeria, and Vietnam.
The Regional Service Centers may be involved in various economic industries throughout the US. Common investment vehicles through the Regional Service Centers may include hotel chains and hospitality franchises. Like any other investment, your selection in any specific Regional Service Center requires a careful approach.
